The Competition and Tariff Commission (Commission) is a statutory body established under the Competition Act [Chapter 14:28]. The present Commission is a product of the merger in 2001 of the former Industry and Trade Competition Commission (ITCC) and Tariff Commission (TC). The ITCC had been established under the Competition Act, 1996 (No.7 of 1996) as a competition regulatory authority, while the TC had been established under the Tariff Commission Act [ Chapter 14:29] as a trade tariffs advisory authority. Both the ITCC and TC had commenced operations in 1998. The merger of the ITCC and TC was provided for under the Competition Amendment Act, 2001 (No.29 of 2001), which also repealed the Tariff Commission Act [Chapter 14:29].

The Commission is looking to recruit suitably qualified personnel for the following position:

Job Title: Senior Investigating Officer
Directorate: Restrictive Practices
Responsible to: Chief Investigating Officer

Job Purpose

Under the overall supervision of the Assistant Director –Restrictive Business Practices and the direct supervision of the Chief Investigating Officer the Senior Investigating Officer shall be responsible for providing legal services and advice in the assessment of restrictive and unfair business practices.

Key Duties/ Responsibilities

  • To undertake investigations into restrictive and unfair business practices provided for in terms of the Competition Act;
  • To assess applications for authorisations made by any person in terms of the Competition Act;
  • To provide legal advice on diverse substantive and procedural issues related to the investigation of restrictive and unfair business practices
  • To develop and implement relevant procedures and manuals relating to inter-alia investigation procedures and search of premises under the Competition Act;
  • To undertake extensive legal research and analysis and prepare legal opinions for use by the Restrictive Practices Division
  • To assist in developing, interpreting and implementing laws, regulations and guidelines relating to restrictive practices
  • To assist in negotiating and drafting undertakings, and ensuring the accuracy of undertakings given by enterprises to the Commission;
  • To ensure that draft decisions of the Restrictive Practices Division take due account of the relevant facts;
  • To ensure compliance by enterprises to the provisions of the Competition Act and provide guidance to business on matters of compliance under the Competition Act as well as assist firms or other persons to draft competition compliance programs;
  • Carry out assessments within prescribed timescales and standards, as required by the Supervisor;
  • To actively participate in the performance management system including group supervision, personal supervision, performance appraisal review, team meetings, and reviews of service; as may be necessary from time to time;
  • To undertake any other tasks consistent with the job description as may be delegated by the Supervisor.

  • Working experience in information collection and analysis

Qualifications and Experience

  • A minimum of a Bachelor of Law Degree or equivalent qualification
  • At least 3 years working experience in competition law enforcement, complex investigations, litigation or legal analysis, research and report writing.
